Wasa and AGF v Lexington
The Court of Appeal has upheld Lexington's appeal from a decision of the English Commercial Court in April last year, effectively allowing it to recover pollution claims for which it was found liable under Pennsylvania law, even though this allocated damage occurring outside the policy period.
